Web Space and Email Hosting Terms and Conditions
Please ensure that you read and understand these conditions. You will be required to signify that you accept these terms and
conditions as part of the ordering process.
Important
Approval for the work to commence and payment of any advance fee indicates that the client accepts the terms and conditions
outlined in this document.
Hosting Packages
PDS Hosting provides a variety of packages, some predetermined and advertised as Bronze, Silver, Gold and Platinum and others specifically created to meet subscriber requirements. All subscribers, except Platinum, can upgrade to another package whenever they need more features, bandwidth (data transfer) or storage space. Platinum customers have the maximum features, bandwidth and storage space from day one.
Downgrades from one package to another are not normally available, however if you have specific acceptable business reasons for a downgrade it will be considered.
Set Up Fee
All hosting packages are supplied on a No (Initial) Set Up Fee basis. Should your hosting service or email service be suspended due to a breach in our Acceptable Usage Policy (click the link to read), PDS Hosting reserves the right to impose a Set Up Fee for reactivating the service/s.
Hosting Contract Duration
All hosting packages are provided on Month-by-Month basis, i.e. there is NO fixed term contract. All we ask is that you pay in advance for the next months hosting and if you wish to cancel, you give us 72 hours notice prior to the commencement of your accounting period. No refunds will be given, should you cancel part way through a month.
Domain Name Registration Terms
A domain name consists of two elements, the name and the suffix. The name typically is related to you or your business. The suffix can be .co.uk, .com, .net etc, etc. Generally you can pick any name that is a) not already in use, b) not offensive or obviously illegal, c) not in breach of someone else’s copyright and d) allowed within the rules laid down by Registration Authorities.
All Domain Name Registration will be conducted in accordance with all and any regulations imposed by the Registration Authority. There are many Registration Authorities, often departments of national governments, who can and do impose their own regulations for use of specific domain suffices. Once PDS Hosting has determined the suffix for your domain, we will provide you with a link to the relevant T’s & C’. We will need you to signify your acceptance of these before we complete the registration process.
Normally all domain names are “rented” to you, i.e. you pay a fee enabling you to use the domain exclusively for a period. The Registration Authorities determine the periods specific name suffices can be rented for, they set their own registration rentals and any set-up fee.
Domain Name Registration Charges
The subscriber shall meet all third party costs arising from the registration of a domain name. PDS Hosting will always register a domain name in the subscribers name unless specifically required to do otherwise. Where PDS Hosting are requested to register the domain in its name, PDS Hosting reserves the right to charge a rental or usage charge for the domain. If at any time the subscriber requests transfer of registration details to themselves, PDS Hosting will agree to transfer this domain name immediately and without charge. PDS Hosting agrees to only one such change of registration details under these terms. Any other arrangements will be subject to separate, specific terms and/or charges. Once PDS Hosting have started the registration process, cancellation of the domain name will not be possible. Once registration is complete, you will though be able to sell the domain if you so wish (subject to any terms imposed by the registrar).
Search Engine Promotion
PDS Hosting are not responsible for the client's on-going web site promotion, unless specifically contracted to carry out such work, other than by offering software packages to assist with this task, as part of the available packages. The search engines control the order in which websites are ranked in the natural search results. While we can optimise your site for this we are unable to make any guarantees about the success of any search engine promotion activity.
Quotations and Pricing
PDS Hosting will advertise on its website(s) prices for Bronze, Silver, Gold and Platinum services. All other packages are subject to customer specific pricing, which will be notified by quotation to your email or in exceptional circumstances, by the postal service. All pricing is displayed ex-VAT at the prevailing rate. This means that currently 17.5% will be added to your bill.
Payment
PDS Hosting uses the PayPal electronic funds transfer system for all payments.
All payments are required in advance, meaning that we will not provide access to your hosting service or email or domain name until we have received confirmation from PayPal that your payment has been successfully made.
Recurring charges will be made for your package until you either upgrade or cancel and monies will be taken every 30-days (on the anniversary of the day the service started) from your Debit or Credit card by PayPal.
If for some reason PayPal are not able to taken a payment from the card number you have lodged with them, PDS Hosting will immediately suspend your service. Such a suspension does not cancel your service or liability for payment of that service. And we reserve the right to impose a "Reactivation Fee" for lifting the suspension.
However, if we cannot resolve the payment issue with you within 28 days from the due payment date, we will delete you account and all of the contents of your web space or email box and use our standard “holding page” to park your domain name. Your domain name will be released or transferred to your new hosting provider ONLY after all outstanding monies have been paid in full.
If payment has not been received within a further 28 days (i.e. within 56 days from the payment due date), the domain name will be offered for sale via our own website.
Cancellation of Services
To cancel any PDS Hosting service you are required to send us an email at least 72 hours before the billing date, detailing the following:
- Your name, email address and contact telephone number
- Your domain name
- Your hosting package name or id number
- Your business name and address
- Your billing date
- Please also indicate what you want done with your web site domain name otherwise we will just park it using our standard “holding page” web page.
Should you have paid for more than one month in advance, we will return the unused portion of your rental. The monies will be paid back via PayPal to the credit or debit card you used to initiate the payments. In plain terms this means:
- If you paid month-by-month and then cancel before the commencement of the next or forthcoming month, no monies will be returned. Similarly, if you cancel part way through a monthly accounting period no monies will be returned for THAT month.
- If you agreed to pay 6 months at once (for example), wish to cancel after 28 days and send the email 72-hours before commencement of the next month, we will return the unused months rental (in this example 5 x the monthly rental value).
Domain Name registration cannot be cancelled once the process has started.
Once a web space or email cancellation request has been received, PDS Hosting has the right to immediately close that account and DELETE all contents of the account. It is your responsibility to ensure that you have downloaded all the contents of your web site or mailbox BEFORE you send the cancellation notice.
Customers who cancel their services and do NOT inform us of what to do with their domain will find that we will use our standard “holding page” to park your domain name. Your domain name will be released or transferred to your new hosting provider on request, via email.
If we hear nothing from you within 56 days from the cancellation date, the domain name will be offered for sale via our own website.
Hosting Support
Bronze package customers are provided with access to our continually updating Support Database and help files located within the Support section of our website(s) and no other technical support.
Silver, Gold and Platinum package customers also have access to our Technical Helpdesk via Email. When contacting the Technical Helpdesk we ask that you include your name, contact phone number and email and the domain name using the hosting package. No support will be provided unless we are able to check the service you are using. Normally aim to get you an initial answer within 24 hours. All responses will normally be via email.
General Notes:
Should PDS Hosting waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit PDS Hosting to waive the same clause on any other occasion.
By agreeing to these terms and conditions your statutory rights are not affected.
PDS Hosting reserves the right to change or modify any of these terms or conditions at any time. Should clarification of any of the above be required please contact Priday Design Studio.
Potential and actual subscribers are asked to read the Priday Design Studio (PDS) and PDS Hosting Acceptable Usage Policy and Privacy Policy in conjunction with these Terms and Conditions and individually and collectively they form the terms of your services from PDS Hosting.
